1. Acceptance of These Terms

These Terms and Conditions (“Terms”) govern your access to and use of the Wishify AI website, products, and services, including the creation of personalized greeting cards, story cards, hero cards, AI-generated images, previews, and downloadable digital files (collectively, the “Services”).

By accessing or using the Services, uploading any content, or placing an order, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Services.

If you are using the Services on behalf of a company, organization, or other legal entity, you represent and warrant that you have authority to bind that entity to these Terms.

2. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Services or place an order. By using the Services, you represent and warrant that you meet this requirement.

3. Description of the Services

Wishify AI provides AI-assisted tools and workflows that generate custom digital greeting cards and related visual content based on text prompts, uploaded images, and other information submitted by users.

The Services may include:

generation of preview images;
watermarked previews;
paid access to high-resolution or downloadable files;
AI-assisted text, design, and image generation;
storage and processing of prompts, uploads, and output files.

Wishify AI may modify, improve, suspend, or discontinue any part of the Services at any time, with or without notice.

4. User Content and Uploaded Materials

You may submit text, prompts, names, messages, photos, images, graphics, and other content through the Services (“User Content”).

You retain any rights you may have in your User Content, subject to the rights you grant to Wishify AI under these Terms.

By submitting User Content, you represent and warrant that:

you own the User Content or have obtained all rights, licenses, consents, and permissions necessary to upload, use, reproduce, modify, process, and authorize Wishify AI to use that User Content;
your User Content, and your use of the Services, do not infringe, misappropriate, or violate any copyright, trademark, privacy right, publicity right, contract right, or other rights of any third party;
any person depicted in an uploaded image has provided all permissions required by applicable law for the use of that image;
your User Content is accurate and not misleading;
your User Content does not contain unlawful, defamatory, abusive, hateful, obscene, sexually explicit, deceptive, harmful, or otherwise prohibited material.

You are solely and fully responsible for all User Content you upload or submit.
You assume full legal responsibility for confirming that you have the right to use every image, photo, design, logo, name, likeness, or other content you upload to the site. Wishify AI does not verify ownership or licensing of uploaded content and is not responsible for any unauthorized use of third-party materials by users.

5. License Granted to Wishify AI

By submitting User Content, you grant Wishify AI a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, process, adapt, modify, transmit, display, distribute, and otherwise use the User Content solely as reasonably necessary to:

provide, operate, maintain, and improve the Services;
generate previews and final outputs;
fulfill your order;
troubleshoot, secure, monitor, and enforce the Services;
comply with legal obligations;
investigate fraud, abuse, infringement, or violations of these Terms.

This license continues for as long as reasonably necessary for the purposes above, including backups, business records, legal compliance, dispute resolution, fraud prevention, and enforcement of these Terms.

6. AI-Generated Output

The Services may use automated systems and artificial intelligence to generate content. AI-generated output may be imperfect and may contain inaccuracies, distortions, unexpected visual elements, or content that does not meet your expectations.

Wishify AI does not guarantee that any generated result will:

be error-free;
meet your exact preferences;
be unique;
be available indefinitely;
be suitable for any particular commercial or personal purpose;
be free from claims by third parties.

You are solely responsible for reviewing all generated outputs before using, sharing, printing, publishing, selling, or relying on them.

7. Orders, Pricing, and Payment

Prices for Services and digital products are displayed on the website and may be changed at any time before purchase.

By placing an order, you agree to pay all stated fees, charges, and applicable taxes.

Where applicable, preview access may be free while download of the high-resolution or final file requires payment.

Wishify AI may refuse, suspend, or cancel any order in cases of suspected fraud, abuse, unauthorized activity, legal risk, technical failure, pricing error, or violation of these Terms.

8. No Refunds; All Sales Final

ALL SALES ARE FINAL.
Because Wishify AI provides customized, made-to-order, and/or digital content, no refunds, returns, exchanges, cancellations, or chargeback claims are accepted once an order is placed, processing has started, a preview has been generated, or digital content has been delivered or made available for download, except where required by non-waivable applicable law.

By purchasing digital content or downloadable files through the Services, you expressly:

request and consent to immediate performance of the Services and/or immediate delivery of digital content; and
acknowledge and agree that, to the extent permitted by applicable law, you lose any right to cancel, withdraw, return, or receive a refund once performance begins or digital content is delivered.

If applicable law in your jurisdiction grants mandatory consumer rights that cannot be excluded, nothing in these Terms limits those mandatory rights.

9. Download Access and Watermarked Previews

Wishify AI may provide watermarked previews prior to purchase and may restrict access to downloadable or high-resolution files until payment is successfully completed.

Preview files may differ from final downloadable files, including by watermark, resolution, compression, file size, format, or other technical characteristics.

Wishify AI does not guarantee permanent hosting, permanent download availability, or permanent cloud storage of purchased files unless explicitly stated on the website.

Users are responsible for promptly downloading and securely storing any purchased files.

10. Data Collection, Storage, and Use

By using the Services, you acknowledge and agree that Wishify AI may collect, receive, store, organize, process, and use:

User Content;
uploaded images and files;
prompts, text, and form submissions;
generated outputs;
technical logs and device/browser information;
transaction and payment-related metadata;
support and communication records.

Wishify AI may retain such data for as long as reasonably necessary to:

operate and provide the Services;
generate and re-generate outputs;
maintain backups and business records;
prevent fraud and abuse;
investigate claims and disputes;
enforce these Terms;
comply with legal, regulatory, tax, accounting, and security obligations.

Your use of the Services is also subject to the Wishify AI Privacy Policy, which forms an integral part of these Terms.

11. Privacy

Wishify AI values privacy and processes personal information in accordance with its Privacy Policy and applicable law.

You acknowledge that internet transmissions and cloud storage are never completely secure and that, while reasonable measures may be used, Wishify AI cannot guarantee absolute security.

12. Prohibited Uses

You may not use the Services:

for any unlawful, infringing, fraudulent, deceptive, or harmful purpose;
to upload material you do not have the legal right to use;
to violate the rights of any person or entity;
to impersonate any person or misrepresent affiliation;
to upload malware, malicious code, or harmful files;
to interfere with, disrupt, or compromise the website or Services;
to scrape, reverse engineer, copy, resell, or exploit the Services except as expressly allowed by Wishify AI;
to generate or submit content that is defamatory, harassing, hateful, obscene, or otherwise unlawful.

Wishify AI may remove content, block access, suspend accounts or orders, and cooperate with law enforcement where appropriate.

13. Intellectual Property in the Services

The website, software, workflows, branding, logos, designs, templates, service marks, text, graphics, and other materials forming part of the Services, excluding User Content and subject to any rights in generated outputs granted below, are owned by or licensed to Wishify AI and are protected by intellectual property and other applicable laws.

Except for the limited rights expressly granted to you, no right, title, or interest in the Services is transferred to you.

14. Rights in Final Deliverables

Subject to your compliance with these Terms and full payment of all applicable fees, Wishify AI grants you a non-exclusive, worldwide, non-transferable license to use the final purchased deliverable for your personal use and any other use expressly permitted on the website at the time of purchase.

Unless explicitly stated otherwise on the website, you may not resell, sublicense, redistribute, or commercially exploit the output as a standalone asset or as part of a competing service.

Wishify AI reserves the right to display anonymized or watermarked examples of generated works for internal records, quality assurance, service improvement, legal defense, and promotional portfolio use, unless prohibited by applicable law or otherwise agreed in writing.

15. Third-Party Services

The Services may rely on or integrate with third-party providers, including hosting, payment processors, AI providers, analytics tools, storage providers, and website infrastructure providers.

Wishify AI is not responsible for outages, errors, delays, data loss, interruptions, or policy changes caused by third-party services.

16. Service Availability

Wishify AI does not guarantee uninterrupted, error-free, or always-available service. Access to the Services may be suspended or limited for maintenance, updates, security reasons, legal reasons, capacity constraints, provider outages, or other business reasons.

17. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

WISHIFY AI DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AVAILABILITY, SECURITY, ACCURACY, QUALITY, OR RESULTS.

WITHOUT LIMITING THE FOREGOING, WISHIFY AI DOES NOT WARRANT THAT:

THE SERVICES WILL MEET YOUR EXPECTATIONS;
THE OUTPUT WILL BE ACCURATE, SUITABLE, ERROR-FREE, OR UNIQUE;
THE SERVICES WILL BE UNINTERRUPTED OR SECURE;
ANY FILE WILL BE AVAILABLE AT ANY PARTICULAR TIME OR FOR ANY PARTICULAR DURATION.

18. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WISHIFY AI AND ITS OWNERS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO THE SERVICES, YOUR USER CONTENT, YOUR USE OF GENERATED OUTPUT, OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF WISHIFY AI FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO WISHIFY AI FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.

19. Indemnification

You agree to defend, indemnify, and hold harmless Wishify AI and its owners, affiliates, officers, directors, employees, contractors, agents, licensors, and service providers from and against any claims, actions, damages, liabilities, losses, judgments, settlements, costs, and expenses, including reasonable legal fees, arising out of or related to:

your User Content;
your use of the Services;
your violation of these Terms;
your infringement or violation of any rights of a third party;
any dispute regarding your right to use uploaded images, names, likenesses, or other materials.

20. Termination

Wishify AI may suspend or terminate your access to the Services at any time, with or without notice, if Wishify AI believes you have violated these Terms, created legal risk, engaged in fraud or abuse, or used the Services in a prohibited manner.

Termination does not affect any accrued rights, payment obligations, licenses already granted, or provisions that by their nature should survive termination.

21. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of [INSERT COUNTRY/STATE], without regard to conflict of laws principles.

24. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices or policies expressly incorporated by reference, constitute the entire agreement between you and Wishify AI regarding the Services and supersede all prior or contemporaneous understandings relating to the same subject matter.
